INTELLECTUAL PROPERTY AND PERMITTED USE POLICY

1. Purpose and legal status

This Intellectual Property and Permitted Use Policy (Policy) governs access to and use of intellectual property made available through the Chance Lab website, applications, accounts, statistical tools, visualisations, reports, content and related services (Service). It forms part of the legal terms governing the Service and must be read with the Terms of Use and other documents incorporated by those Terms.

This Policy does not transfer ownership of any intellectual property. It does not exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified.

2. Chance Lab intellectual property

As between the user and Chance Lab, OCEANSKY ENTERPRISES PTY LTD and its licensors own or control all rights, title and interest in the Service and its protected elements, including software, source and object code, architecture, interfaces, visual design, graphics, text, documentation, reports, compilations, database selection and arrangement, data models, taxonomies, workflows, statistical methods, scoring and ranking systems, analytical structures, prompts, configurations, brand assets and other materials created or supplied by Chance Lab (Chance Lab Materials).

Chance Lab Materials may be protected by copyright, trade mark, confidential information, contract and other laws. The absence of a registration notice or rights symbol does not waive any right. Rights in third-party materials remain with their respective owners.

3. Limited personal licence

Subject to the Terms of Use, payment of applicable fees and continued compliance with this Policy, Chance Lab grants the user a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Service and Chance Lab Materials made available to that user for the user's own lawful, non-commercial information, education and personal analysis.

The licence permits ordinary on-screen viewing and use of user-facing features. Any download, export, print or sharing function is permitted only to the extent expressly enabled by the Service and only for the purpose and volume reasonably contemplated by that function. No implied licence is granted.

4. Ownership of user content

As between the user and Chance Lab, the user retains any intellectual property rights the user lawfully holds in original notes, labels, selections, combinations, feedback attachments or other content submitted by the user (User Content). Historical draw facts, numbers, ideas, methods and other material not protected as the user's intellectual property do not become owned by the user merely because the user enters, selects or arranges them.

The user represents that the user has the rights and permissions necessary to submit User Content and that doing so does not infringe another person's rights or law.

5. Licence to operate the Service

The user grants Chance Lab a worldwide, non-exclusive, royalty-free licence to host, reproduce, process, format, transmit, display and otherwise use User Content only as reasonably necessary to provide, secure, maintain, support and improve the Service; comply with law; enforce the legal terms; prevent fraud or misuse; and respond to the user's instructions.

This operational licence continues for as long as reasonably required for those purposes, including applicable retention and backup periods. It does not authorise Chance Lab to sell the user's private User Content as standalone content or to grant an unrelated third party an independent right to market using that content. Aggregated or effectively de-identified information may be retained and used in accordance with the Privacy Policy.

6. Outputs and combinations

Subject to this Policy, a user may use a combination, note or report generated for that user for personal purposes. The user does not acquire ownership of the underlying software, analytical method, model, database, interface, template, ranking logic, explanatory text or other Chance Lab Material used to create or present an output.

Outputs may be similar or identical for different users because they may use common facts, rules, numbers, templates, methods or automated processes. Chance Lab does not assign exclusive rights in an output, promise that an output is unique, or prevent lawful independent creation by others.

7. Prohibited copying and extraction

Except where expressly permitted by the Service or mandatory law, a user must not copy, reproduce, republish, mirror, frame, archive, translate, adapt, distribute, publicly display, communicate, sell, licence or commercially exploit a substantial or systematic part of the Service or Chance Lab Materials.

A user must not use scraping, crawling, bots, scripts, browser automation, bulk export, data mining or similar means to extract, index, reconstruct or compile Service content, datasets, results, combinations, account information or metadata; bypass pagination, rate limits, permissions or technical controls; or build a substitute dataset, product or service.

8. Prohibited technical and competitive use

To the extent permitted by law, a user must not reverse engineer, decompile, disassemble, decode, probe, discover source code, derive underlying models or methods from, or create derivative software based on the Service; test or scan the Service for vulnerabilities without prior written authorisation; interfere with integrity or security; remove rights notices; or conceal the source of copied material.

A user must not use Chance Lab Materials, protected outputs or access to the Service to train, fine-tune, benchmark, evaluate or improve a machine-learning or artificial-intelligence system; develop or operate a competing or substitutable product; provide a bureau, white-label or resale service; or assist another person to do so, unless Chance Lab has given prior written permission. This restriction does not prevent lawful use of the user's own content independently of the Service.

9. Accounts, access and circumvention

Access rights attach to the authorised account and plan. Users must not share, sell, rent or transfer credentials or access; enable unauthorised persons to use Plus or controlled features; create accounts to evade suspension, limits or payment requirements; or use another person's account or entitlement.

Chance Lab may apply reasonable technical, contractual and operational controls to protect intellectual property, security, capacity and paid entitlements and may investigate, limit, suspend or terminate access where it reasonably suspects infringement, extraction, circumvention, misuse or material breach.

10. Trade marks and attribution

Chance Lab, its logos, product names, visual identifiers and related branding are trade marks or brand assets of OCEANSKY ENTERPRISES PTY LTD or its licensors. No right is granted to use them in a business name, domain, social account, application, advertising, metadata, keyword, endorsement claim or other manner likely to imply affiliation, approval or origin.

A user must not remove, obscure or alter copyright, trade mark, attribution, confidentiality or other proprietary notices. Limited factual reference to Chance Lab must be accurate, lawful and not misleading.

11. Feedback

If a user voluntarily provides an idea, suggestion or feedback about the Service, the user grants Chance Lab a worldwide, perpetual, irrevocable, non-exclusive, royalty-free and transferable licence to use, reproduce, adapt and implement that feedback without restriction or payment. This does not transfer ownership of unrelated confidential material clearly identified and accepted by Chance Lab as confidential before disclosure.

Users should not submit ideas they do not have authority to disclose or expect Chance Lab to treat as confidential.

12. Third-party and public information

The Service may identify lottery games or display information originating from public or third-party sources. Such reference does not transfer third-party rights to Chance Lab or the user, and does not imply sponsorship or endorsement. Users must comply with any applicable third-party rights and source terms when leaving the Service or independently reusing third-party material.

Facts and information that are not protected by intellectual property law may still be subject to contractual access restrictions, privacy, confidentiality, security and laws governing misuse or automated access.

13. Infringement notices and enforcement

A person who reasonably believes material available through the Service infringes that person's intellectual property rights may contact Chance Lab using the details below and should identify the protected work or right, the allegedly infringing material and its location, the basis of ownership or authority, contact details and a statement that the notice is accurate and made in good faith.

Chance Lab may request further information, preserve relevant evidence, remove or restrict material, suspend access, notify affected parties or take other reasonable action. Chance Lab is not required to determine complex ownership disputes and may refer parties to the appropriate court, authority or dispute process. Knowingly false, misleading or abusive notices may result in restriction of access and liability under applicable law.

14. Enforcement, remedies and responsibility

Unauthorised use may cause serious and difficult-to-quantify harm. Chance Lab may use lawful technical controls, suspension, termination, evidence preservation, takedown requests, injunctive relief, damages or other available remedies. Failure or delay in enforcement does not waive a right.

To the extent permitted by law, a user is responsible for direct loss, reasonable investigation and enforcement costs, and third-party claims caused by the user's intentional or material infringement, unlawful extraction, circumvention or misuse. This responsibility is reduced to the extent Chance Lab caused or contributed to the loss and does not apply where prohibited by law.

15. Exceptions required by law

Nothing in this Policy prohibits an act that applicable law expressly permits and does not allow the parties to restrict. Where a legal exception depends on conditions, the user must satisfy those conditions and must not exceed the permitted scope. A user relying on such an exception should, where lawful and practicable, contact Chance Lab before undertaking conduct that could affect security, confidentiality, service integrity or other users.

Chance Lab does not exclude liability for fraud, wilful misconduct, breach of a non-excludable statutory guarantee or any other liability that cannot lawfully be excluded.

16. Changes to this Policy

Chance Lab may update this Policy to reflect changes to the Service, technology, risks, law or reasonable operations. The updated document will be published on this page with its effective date. Material changes affecting existing paid users will be handled in accordance with the Terms of Use and applicable law.
