1. Purpose and legal status
This Marketing Communications Consent explains the basis on which OCEANSKY ENTERPRISES PTY LTD, trading as Chance Lab, may send marketing communications to a person who chooses to receive them. It forms part of Chance Lab's legal terms and should be read with the Privacy Policy, Terms of Use and Cookie and Similar Technologies Statement.
This Consent does not limit any right that cannot lawfully be excluded. It does not require Chance Lab to send any particular communication, offer or benefit.
2. Voluntary opt-in
Marketing consent is voluntary. Creating an account, using Free functions, purchasing or renewing Plus, accepting the Terms of Use, or contacting support does not by itself constitute consent to receive marketing communications.
A person opts in only by taking a clear affirmative action presented for that purpose, such as selecting an unticked marketing checkbox or completing another clearly identified subscription process. Chance Lab may require confirmation of an email address or use another reasonable verification step before activating marketing communications.
3. Communications covered by consent
By opting in, the recipient authorises Chance Lab to send commercial electronic messages to the email address supplied for marketing, including information about Chance Lab features, Plus plans, offers, promotions, educational or statistical content, product updates, surveys, research participation, events and other Chance Lab products or services that may be relevant.
The frequency and subject matter of communications may vary. Consent does not guarantee that every communication will be relevant to the recipient or that an offer will remain available. Any promotion may be subject to separate eligibility criteria, time limits and terms.
4. Sender and service providers
Marketing communications are authorised by OCEANSKY ENTERPRISES PTY LTD, trading as Chance Lab. Chance Lab may use contracted email, hosting, customer-support or communications service providers to prepare, transmit, secure and measure delivery of communications on its behalf.
Those providers act for operational purposes and are not authorised by this Consent to use the recipient's contact details for their own independent marketing. Chance Lab will not authorise an unrelated third party to market its own products under this Consent unless the recipient is clearly informed and any additional consent required by law is obtained.
5. Identification and delivery information
Marketing messages will identify Chance Lab or the legal entity that authorised the message and will include contact or sender information required by applicable law. Chance Lab may process delivery, opening, link-interaction, bounce, complaint and unsubscribe information where supported by the communications system and permitted by law, for delivery, security, preference management, campaign assessment and compliance purposes.
A recipient must not misuse unsubscribe links, message headers, sender identities or other communication functions, or use them to interfere with systems, impersonate another person, introduce malicious code or conduct unlawful activity.
6. How to withdraw consent
A recipient may withdraw marketing consent at any time by using the unsubscribe facility included in a marketing message or by emailing chancelabai@gmail.com with the subject 'Unsubscribe'. The recipient should identify the email address to be unsubscribed. Chance Lab will not require account login or unnecessary personal information merely to process an ordinary email unsubscribe request.
Chance Lab will action a valid unsubscribe request as soon as reasonably practicable and within the period required by applicable law. Communications already queued or sent before the request is processed may still arrive. Withdrawal applies prospectively and does not make earlier lawful communications unlawful.
7. Service and transactional communications
Withdrawing marketing consent does not prevent Chance Lab from sending non-marketing communications reasonably necessary to operate or protect the service or the relationship with the recipient. These may include account verification, password reset, security, fraud, subscription, billing, payment, cancellation, refund, support, legal, privacy, service-change, outage and administrative notices.
A service message will not be treated as non-marketing merely because Chance Lab labels it that way. If a message includes marketing content, Chance Lab will treat it according to applicable marketing-message requirements.
8. Records of consent and withdrawal
Chance Lab may retain records reasonably necessary to demonstrate and administer consent, including the email address, consent wording or version, date, time, source, verification status, preferences, communications history, unsubscribe request and suppression status. Such records may be retained after withdrawal or account closure where reasonably necessary for compliance, audit, security, dispute handling or to prevent further marketing.
Chance Lab may maintain a suppression record so that a withdrawn address is not inadvertently re-added. A recipient who later wishes to opt in again must complete a fresh, clearly identified consent process. Chance Lab is not required to accept a new opt-in where there is a security, abuse, deliverability or legal concern.
9. Recipient responsibilities
A person providing an email address must be authorised to use it and must not subscribe another person without authority. The recipient should keep contact information accurate and protect access to the relevant email account.
Chance Lab may suspend or refuse marketing enrolment, verification or delivery where an address is invalid, unverified, associated with complaints or abuse, creates a security or deliverability risk, or where continued communication may be unlawful or operationally inappropriate.
10. No sale, lottery entry or Plus entitlement
Opting in is not a purchase, lottery entry, wager or guarantee of access to Plus, a discount, a prize, a particular feature or any financial or lottery outcome. Marketing content does not replace the Terms of Use, Subscription & Billing Terms, Refund & Cancellation Policy or the specific terms of an offer.
11. Privacy
Chance Lab handles contact details, preference information and communications data in accordance with its Privacy Policy. A request to unsubscribe from marketing is not a request to delete an account or all personal information. Account deletion and data-rights requests are governed separately by the Account Deletion & Data Rights Statement.
12. Changes
Chance Lab may update this Consent to reflect changes to its communications, systems or legal obligations. The updated document will be published on this page with its effective date. Where a change materially expands the scope of an existing consent, Chance Lab will obtain further consent where required by law rather than relying on the earlier consent beyond its lawful scope.
